Art Commissions Terms of Service

1. Transactions are paid in full upfront.
This is not negotiable. This is put in place to avoid the artist getting scammed out of money and time. The available payment options include PayPal or Ko-fi. If Ko-fi is the payment method of choice, a redirect link is available on BoulevardCharms' main webpage—there is a redirect button to the webpage itself at the bottom of the commission site. If Paypal is the payment method of choice, the customer's concurrent email will be required to fulfill payment for the commission via invoice. All transactions must be paid in USD currency only.2. Additional charges.
It is imperative the customer communicates with the artist the desired specifics of the art commission. This includes character poses, atmosphere, etc. If by chance the customer requests something that is uncommon or relatively complex for the artist's skills, the artist may charge an extra 20% (from base price).Base price is the raw starting amount of the commission based on character calculation(s). This value is the foundation the artist uses when adding on any percentage costs.3. References are required.
To ensure the artist can satisfy the expectations of the customer, character references are a must. Lack thereof, text or audio descriptions, sample images, or any other form of articulation are not viable options. The artist advises commissioners to provide references that contain a full body image of the character desired—preferably without shading or any other distortions made on the character's base colors—with all other details discussed.This does not apply to reference sheet commissions. However, the customer should be prepared to present samples based on species, clothing, colors, etc. in the event of purchasing.4. Commission corrections.
The artist will examine their tools and resources, producing a fine sketch before proceeding to the next step in refinement. Addressing errors during the sketch stage is most optimal for the artist, while outline stage corrections are also doable. However, once the commission proceeds onto shading and/or rendering, further corrections may be limited. For this reason, the artist gives the customer as many times necessary to review the WIPs before proceeding through with the commission. The artist will check in periodically with progress updates where the commissioner may freely observe and critique the rough draft.5. Commission deadlines.
The customer may expect their product within 1–7 days, or otherwise when specified by the artist. Customers are allowed to inquire about the progress of their commission as long as it is not excessive or pestering. If the customer would like their commission to be done at a deadline, the artist will examine options to accommodate. The customer can pay a $10 fee for a high-priority commission that can be finished within 1–3 days.If the artist does not provide the commission within the promised deadline, the customer may have the option to request compensation. These options include a free commission coupon of $30, or a 50% partial refund. (Please review the "Refund Policy" section.) As for the artist's defense, limitations of reasons for delay include work load, vacation, sickness, or immediate private matters. The artist must state claim to the following within 48 hours before the deadline.6. All commissions will be watermarked.
The BoulevardCharms watermark authenticates and protects their work. The watermark must never be removed—the customer does NOT have the authority to remove the watermark with any tool, software, or any other related resource for any reason. If the customer would like a copy of the commission without the watermark, the artist may fulfill this request upon the customer spending an extra $25.With the current surge of AI tools, BoulevardCharms by NO MEANS WHATSOEVER gives consent to their work being utilized for, or educating, generative AI of ANY KIND. Nor will the artwork be affiliated with NFTs (non-fungible tokens) or any cryptocurrencies.7. Merchandise use.
The customer will not use the commissioned artwork for any mass-produced, commercial use. Only personalized use of the artwork (e.g. profile pictures or profile banners) are allowed.This does not apply to character references produced by BoulevardCharms. Such property has its ownership donated to the commissioner by the artist to use however they see fit. Limits apply via Rule 6 of BoulevardCharms' Art Commissions ToS.8. By purchasing a commission from BoulevardCharms, you AGREE to BoulevardCharms' Art Commissions ToS.
The customer must abide to these rules as so to respect the artist and the artist's work. The finished commission may also be published on BoulevardCharms' social media outlets as per their right to display or subject it to advertisement unless the customer requests otherwise. BoulevardCharms reserves the right to deny service for any or no reason. If violations against ToS occur before or during commission production, a refund will be issued. (Review our "Refund Policy" for more information.) Impatient behavior will not be tolerated nor will the customer behave rude or brash in any way, shape, or form. If the customer violates the stated terms, they may be blacklisted from future purchases.

Refund Policy

It is a reminder that the artist is human. Time is a valuable factor that contributes to the artist's success of both their business and creativity. Unfortunately, the artist does not provide any refunds once payment is complete. However, refunds are reserved only for the following specific circumstances...

  • The customer will receive a full refund if the artist is unable to complete the commissions for whatever reason.

  • The customer will receive a partial 50% refund if the artist fails to deliver within the deadline set by ToS, unless specified otherwise 48 hours before the deadline. (The high-priority commission fee of $10 is a guaranteed refund on top of the designated 50% if the commissioner doesn't receive their art within 1-3 days as promised.)

  • The customer will receive a full refund if they are caught violating ToS.
